Schools and Colleges will need to register with the UK Border Agency in order to sponsor overseas students who wish to come to the United Kingdom in order to study. If the institution has not been registered by September 2009 it will not be able to sponsor students from overseas. Time is of the essence, as over 15,000 institutions will need to be registered under this provision, a process which is likely to lead to back log and a failure by some institutions to be registered in time for the forthcoming academic year.
The facility of sponsorship is matched by a continuing duty to monitor the student's attendance at school and immigration activity. Notifying the UK Border Agency of a non compliance could lead to cessation of the student's immigration status. Failure to notify, could result in the withdrawal of sponsorship, and the loss of immigration status for all other sponsored students. Schools and Colleges retain a duty to act in the best interests of the child for which the current Sponsorship guidance makes no provision. Such a duty must not be overlooked in the dash to register.
